A contract of service is an agreement between an employer and an employee that govern the employer-employee relationship by providing terms and conditions of employment.

WHEREAS  the Employer wishes to retain the Employee’s services and the Employee wishes to render such services according to the terms and conditions agreed hereunder

WHEREBY THE PARTIES AGREE AS FOLLOWS: 

1 Position

The Employer hereby employs the Employee as a………….., and the Employee accepts and performs the stated employment by complying with all company policies, rules, and procedures at all times.

2. Duration

This agreement will take effect on [insert date] It shall be binding indefinitely until it is terminated in accordance with the conditions of this agreement.

3. Remuneration

The Employee will be paid $…………….. [per hour/per annum] as remuneration for the services supplied and will be subject to [quarterly/annual] performance evaluation.

All payments will be subject to required deductions for work (State & Federal Taxes, Social Security, Medicare).

4. Other benefits

The Employee is entitled to participate in any of the Employer’s benefit schemes. The employer currently provides [add the list of benefits]. These perks will be available only after the probationary term has ended.

5. Probation Period

A probationary term is regarded to be the initial [time period] of employment.  During this time, the Employer retains the right to terminate employment at any time and without cause.

6. Duties of employee

The EMPLOYEE’S primary responsibilities to the EMPLOYER are to obey all lawful and reasonable orders and to complete any task-directed to her or him that is within her or his vocational ability.

Without limiting the foregoing responsibilities, the EMPLOYEE must strictly adhere to the terms of this agreement, may not misappropriate the EMPLOYER’s property, must keep all information entrusted to him/her confidential, and must follow the general Code of Conduct that governs all interactions with coworkers, clients, and patients.

The EMPLOYER will prepare a duty sheet in line with the job description, which will be put in the EMPLOYEE’s personnel file.

7. Hours of service

On weekdays, service will be available from 8:00 a.m. to 17:00 p.m. The EMPLOYEE will be expected to work on Saturdays from…… to ……. The EMPLOYER, on the other hand, will not expect the employee to work more than 45 hours a week during normal business hours.

The EMPLOYEE will be entitled to a thirty-minute uninterrupted meal period. In most cases, interruptions are not authorized; however, operational conditions may necessitate an interruption, in which case equal time off will be provided.

8. Confidentiality 

You will have access to confidential information that is the Employer’s property as an Employee. You are not allowed to share this information with anyone outside of the Company.

9. Termination

This agreement may be terminated by either party giving the other a one-month written notice of service termination, provided that such notice is given on the first day of the month in question.

An EMPLOYEE is entitled to a Certificate of Service upon cessation of employment.

10. Governing law

This contract shall be governed, interpreted, and construed in accordance with the laws of [state, province, or territory].

11. Entirety

This contract contains the full agreement between the parties and replaces all prior written or oral agreements. This agreement may be changed at any time with both the Employer’s and the Employee’s written permission.

THE REGISTERED TRUSTEES OF ABC ACADEMY a body corporate registered under …………………….. Act of ………………….hereinafter called “the Employer”) of the one part

WHEREBY IT IS WITNESSED as follows:-

1. The Employer hereby employs the services of the Employee as a…………… and the Employee accepts and takes up the said employment on the terms following hereunder.

3. The Employee’s basic salary shall be ………….. (amount in words) per month.  The Employee shall further be paid………….. 4. On successful completion of the contractual term herein agreed the Employee shall be entitled to a Gratuity calculated at a rate of ten percent (10%) of the total package earned by him during the entire contractual period.

5. the Employer the Employee shall each contribute ten percent (10%) of the Employee’s basic salary to the National Social Security Fund for every month that the contract shall remain in force for purposes of the Employee’s social security fund.

6.  The Employee shall be entitled to twenty-eight (28) days annual leave for each year of service under the contract.

7. The Employee shall observe and abide by a professional code of conduct.

8. Either party who terminates this Agreement prior to the expiry of the contract such party shall pay to the other party three (3) months’ total package payable to the Employee.
