let’s get started

What is a character witness letter for court

A character witness letter for court is a brief statement of facts written to the court by friends, family, colleagues, or anyone else who knows the defendant in the case, to establish credibility in the defendant’s character and to aid the judge to have a deeper understanding of the defendant outside of the facts of the case prior to judgment.

let me explain how this letter works through the example below

For example, your friend Bob Brown is facing DUI charges. The court will usually only allow a specific number of live witnesses to testify on a defendant’s character before sentence, but will also accept nearly any number of character witness letters.

Because Bob is a close friend of yours, you could write a character witness letter to the court to testify that Bob has shown a persistent and determined attitude in productively and successfully overcoming his mistake (add examples and instances to support your assertions) and you could ask the court to consider the statements in your letter so that it can rule in your beloved friend’s favor.

That’s it, That’s how it works.

Your letter is a golden chance to help your friend get the court clemency, it can greatly influence the judge in sentencing your friend, so never take it for granted.

Character references for court are typically offered in child custody and/or drunk driving (DUI) cases, but they can be utilized in any situation where the court needs to hear about the Defendant’s personality and reputation in order to decide the case in their favor.

I have already shared the samples of character reference letters in child custody and DUI cases, You can check them here

Purpose of character witness letter for court

The primary goal of a character reference for court is to present the Judge with a detailed written statement on the Defendant’s reputation, morals, and mental qualities.

A court character reference letter helps the judge or jury in understanding who the defendant really is beyond the facts of the case.

It may also allow a lawyer to craft a compelling defense for the defendant by directing the character witnesses to focus the court’s attention on the defendant’s character.

At the end of the day, a character reference for the court has an impact on the final sentence imposed in the case, whether it is civil or criminal.

You might not know it, but character reference letters for court appearances can play a significant role in defining the remainder of your friend’s or relative life. The mere fact that your friend appears in court is enough to say something, and it is for this reason that there is no room for error.

The assessment of your friend’s or relative attributes is the only thing that matters when you are writing a character witness letter.

How to write a character witness letter for court

The format of a character witness letter for court is a business letter. Begin with your address and contact information, then write a date and the court/judge’s address, then salute the judge and open your letter by introducing yourself and saying that you are writing the letter on behalf of the defendant, then proceed by writing all relevant facts and evidence capable of establishing credibility in the defendant’s character and assisting the judge in having a deeper understanding of the defendant. Close your letter by highlighting why a court should take your letter seriously.

When choosing someone to write a character reference for you, it is vital to choose someone who has known you for a long time and who the court will respect.

For example, it is great if you can obtain someone from the community, such as a teacher, employer, co-worker, friend, or family member to write a promising character reference for the court.

Also if someone has chosen you to write a character reference letter on his behalf make sure you know that person very well.

Remember your relationship with the defendant and vice versa matters a lot when it comes to character witness issues.

Things may sound a little intimidating by now, so I think I should break everything down into step-by-step instructions with examples.

Re: Character reference letter for Mr. Bob Brown, Defendant Drunk Driving Case number 2030/00021

Opening Paragraph (s)/ Introduction

Begin your letter by introducing yourself and stating your relationship with the defendant plus how long you’ve known him stating that you are writing on the defendant’s behalf.

for example

Your Honor, with great enthusiasm I am writing on behalf of Mr. Bob Brown, the defendant in the Drunk Driving Case number 2030/00021 before you,

Bob and I have been close friends for thirty (33) years. Mr. Bob has consistently proven to be a man of high integrity. He is well known for having a good character, being a respectable husband and parent, and being a trustworthy member of the community. As a result, his transgression comes as a complete surprise.

Body paragraphs

The body paragraph should be your main argument for why a defendant is a moral person. If he is a friend, for example, your body paragraphs should express how essential he is to his family, workplace, and community at large, and you should beg the Judge to be lenient in his case.

If it is a child custody case, you should include how important the children are to the defendant.

for example

Mr. Bob admitted to me that he had acted rashly and exhibited sorrow, as well as a strong desire to tackle the personal issues at the heart of the problem.

As a friend, I was aware of some personal difficulties in Mr. Bob’s marriage and professional life. This had to have severely overwhelmed him and impaired his ability to cope with life. Mr. Bob has already enrolled and started attending counseling meetings, so I feel he intends to improve. Bob has always had a fiery personality and a great desire to improve himself.

Regardless of the challenges, he will experience, I am convinced that Bob Brown will develop the essential skills to prevent repeating such a disastrous decision. Bob will undoubtedly benefit from the counseling he is receiving and will return to being a stable, wonderful member of this community.

Mr. Bob has shown a tenacious and determined approach to overcoming this mistake constructively and successfully thus far.

Closing paragraphs/conclusion

In the end, explain the objective of the letter and include contact information (phone and e-mail) in case the court wishes to follow up on any of the information mentioned in the letter.

for example

I feel this letter offers valuable information that you should examine while deciding on Bob’s case. For any questions, please do not hesitate to contact me through frank.george @email.com or 555-111-2222.

Sincerely

Re: Child custody Case Number 2022/00001

Dear Honorable Judge Smith

This letter is in support of Hellen Brown’s custody requests.

I’ve known Hellen and her husband, James, for the majority of their marriage and their child’s whole life as Hellen’s best friend, neighbor, and coworker for 7 years.

Hellen is an excellent mother who works hard to be a positive influence on her kid. Based on my deep and personal knowledge of the family, I strongly support Hellen Brown’s move for primary physical custody and sole legal custody. I believe her arrangements are in Jane’s best interests.

Hellen’s dedication to nurturing her girls’ interests and skills while giving the necessary structure and guidance has always impressed me. She has also always been actively involved in all aspects of her care. For example, when it came time for Jane to start school, she performed extensive research and sought my expert advice. Susan also sought out the best experts for Jane’s diagnosis and treatment when she began to develop ADHD symptoms.

I’ve noticed that absolutely nothing about their parenting arrangement has altered after James moved away. Hellen is still the primary caretaker, and James pays occasional visits to the girl. Hellen remains the more caring and compassionate mother. Maintaining Jane’s stable dynamic, in which her mother provides the vast majority of her care in the home where they’ve lived their entire lives, is the best thing for her, in my opinion. I also believe that Hellen should have custody of her daughter in the best interests of both Hellen and James.

I feel this letter contains essential information that you should consider when awarding custody orders.

For any questions, please do not hesitate to contact me through frank.george @email.com or 555-111-2222.

Sincerely

George Frank
